Terms of Service
These Terms of Service ("Terms") govern your access to and use of CertAttestor (the "Service"), operated by CertAttestor ("we", "us"). By accessing the website, verifying a credential, or registering as an issuer, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind it.
1. The Service
CertAttestor provides tools to issue digitally signed credentials, notarize them, optionally anchor them on a public blockchain, and verify them. The Service establishes the authenticity and integrity of credentials within its own trust domain. It is not a government-accredited certificate authority and is not a notary; it does not provide legal notarization, and its signatures are not government-qualified electronic signatures.
2. Eligibility and accounts
You must be at least the age of majority in your jurisdiction and provide accurate, complete registration information. You are responsible for safeguarding your account credentials and for all activity under your account, and you must notify us promptly of any unauthorized use.
3. Issuer approval and responsibilities
Organizations may issue credentials only after being vetted and approved. As an issuer, you are solely responsible for the accuracy, lawfulness and content of every credential you issue, for having the authority and rights to issue it, and for obtaining any consents required to submit holder data. You are the controller of the personal data you submit and must handle it in accordance with applicable law and our Privacy Policy. You must revoke credentials that are no longer valid.
4. Acceptable use
You agree not to: use the Service unlawfully or fraudulently; issue false, misleading or unauthorized credentials; impersonate any person or organization; infringe the rights of others; upload malicious code; probe, scan or attempt to breach the Service’s security; interfere with its operation; or use it to build a competing product. We may investigate and take appropriate action, including suspension, for any suspected violation.
5. Verification and no guarantee of underlying facts
A verification result reflects whether a credential’s signature is valid, whether the register reports it active, and its notarized and revocation status — based on information supplied and maintained by the issuing organization. We do not independently verify, and do not guarantee, the truth of the facts a credential asserts or the identity or trustworthiness of any issuer. Blockchain anchoring provides an independent timestamp of a record’s existence; it does not determine whether a credential is currently valid.
6. Plans and fees
The Service offers a free tier and paid (Pro) features. Fees, billing terms and the features included in each plan are as described at the point of purchase or in your order. Unless stated otherwise, fees are exclusive of taxes, and we may change pricing or plan features prospectively on reasonable notice.
7. Intellectual property
We and our licensors own the Service, its software, design and trademarks. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service. You retain ownership of the content you submit and grant us the rights necessary to host, process, display and verify it in order to provide the Service. You may not copy, modify, distribute or reverse-engineer the Service except as permitted by law.
8. Third-party services
The Service relies on third-party providers for hosting, content delivery and security, sign-in, key management and blockchain anchoring. Your use may be subject to their terms, and we are not responsible for their acts, omissions or availability.
9. Availability
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. The Service may be unavailable during maintenance or for reasons beyond our control, and features may change over time.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
11. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or business, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim or a nominal amount permitted by law.
12. Indemnification
You agree to indemnify and hold us harmless from claims, losses and expenses (including reasonable legal fees) arising from your content, the credentials you issue, your use of the Service, or your breach of these Terms or of applicable law.
13. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or others. On termination your right to use the Service ends, and provisions that by their nature should survive will survive. Public verification of previously issued credentials may continue unless and until they are revoked or removed.
14. Governing law and disputes
These Terms are governed by the laws of the Republic of the Philippines, without regard to its conflict-of-laws rules, and you agree to the jurisdiction of the competent courts of the Philippines, unless a mandatory law of your place of residence provides otherwise.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected in the version and effective date shown, and your continued use of the Service after the changes take effect constitutes acceptance.
16. Miscellaneous
If any provision is held unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. These Terms are the entire agreement between you and us regarding the Service and supersede prior agreements on that subject.
